These Terms of Service ("Terms") apply to your use of the GasUp website. By using the website, you agree to these Terms.

1) Operator

The service is provided by Gas Up, Inc. d/b/a GasUp ("GasUp," "we," "us," or "our").

GasUp is headquartered in Readyville, Tennessee.

2) Website Scope and Launch Stage

This is a website-stage launch. Current website functionality includes informational content, waitlist signup, and contact submission.

Current launch planning may include parts of the Nashville and Murfreesboro areas, but all operations are currently Tennessee-based.

3) No Service Contract or Guarantee

Submitting a waitlist form or contact form does not create a fuel delivery contract, dispatch commitment, guaranteed launch date, or guaranteed service availability.

4) Acceptable Use

You agree to use the website lawfully and not to:

  • Submit false, misleading, or impersonated information.
  • Use bots or automated methods to scrape, spam, or overload the website.
  • Bypass or interfere with security or abuse-prevention controls.
  • Upload malicious code or attempt unauthorized access.
  • Use the website in violation of law or third-party rights.

5) User Submissions

You are responsible for information you submit through the website forms. You represent that you have the right to provide that information and that it is accurate to the best of your knowledge.

You authorize us to use submissions to operate the website, respond to inquiries, and plan launch coverage, consistent with our Privacy Policy.

6) Third-Party Infrastructure

We use third-party providers, including Cloudflare services, for hosting, traffic management, and security. Your use of the website may also be subject to applicable third-party terms.

7) Intellectual Property

The website and its content, branding, design, and software (excluding third-party content) are owned by us or our licensors and are protected by applicable intellectual property laws.

8) Suspension and Availability

To the fullest extent permitted by law, we may limit, suspend, or terminate access to the website for security, abuse prevention, legal compliance, maintenance, or violations of these Terms.

9) Disclaimers

To the fullest extent permitted by law, the website is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.

To the fullest extent permitted by law, we do not guarantee uninterrupted operation, absolute security, or correction of all errors on any specific timeline.

10) Limitation of Liability

To the fullest extent permitted by law, GasUp and its affiliates, officers, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, business opportunities, or data, arising out of or related to the website or these Terms.

To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to these Terms or your use of the website will not exceed the greater of: (a) USD $100; or (b) the amount you paid GasUp for website-related services in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.

11) Indemnification

You agree to indemnify and hold harmless GasUp from claims, liabilities, damages, losses, and expenses arising from your violation of these Terms or misuse of the website.

12) Non-Waivable Consumer Rights

Nothing in these Terms waives or limits any non-waivable consumer rights or remedies you may have under applicable law.

13) Governing Law and Venue

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, disputes must be brought in:

  • the state courts located in Cannon County, Tennessee; and
  • if federal jurisdiction applies, the United States District Court for the Middle District of Tennessee, Nashville Division.

You and GasUp consent to personal jurisdiction in these courts for covered disputes.

14) Changes to These Terms

We may update these Terms from time to time. The effective date above reflects the latest version. Changes become effective when posted to this page unless otherwise required by law.
